Please Read These Official Rules With Your Parent or Legal Guardian.
NO PURCHASE, TEXT OR PAYMENT NECESSARY TO ENTER OR WIN.
Many will enter, few will win. A Purchase Will Not Increase Your Chances of Winning.
Eligibility: Sour Sweet Gone® Auction ("Sweepstakes") is open to legal residents of the 50 United States and the District of Columbia who are 13 years of age or older as of date of entry. All entrants under 18, or who are considered minors in their state of residence, must have a parent’s or legal guardian’s permission to participate in this Sweepstakes. Officers, directors, employees, representatives, and agents of Cadbury Adams USA LLC ("Sponsor"), Gold n Fish Marketing Group LLC, or Project Support Team, Inc., or any of their respective parents, affiliates, subsidiaries, retailers, distributors, suppliers, and advertising and promotion agencies (collectively, the "Released Parties"), and any immediate family member (for the purposes of this Sweepstakes, defined as a parent, spouse, child, or sibling, regardless of where they reside) of such officers, directors, employees, representatives, or agents are not eligible to enter or win a prize. Void in Puerto Rico and where prohibited or restricted by law.
Promotion Period: Sweepstakes begins 12:00:00 pm (noon) Eastern Time ("ET") on 5/19/08 and ends 11:59:59 am ET on 11/30/08 (hereafter, "Promotion Period"). The Promotion Period will be divided into twenty-eight (28) Weekly Entry Periods (see chart below).

How To Enter: To enter for a Weekly Entry Period, you will be required to submit a bid (you will not be required to purchase the item you "bid" on in order to win a prize; placing a bid is solely for the purpose of entering the Sweepstakes), during that Weekly Entry Period, on the applicable Weekly Prize. As outlined in the prize chart below, each Weekly Prize consists of a "sweet" prize and a "sour" prize. Bidding will be on the entire Weekly Prize, (inclusive of both the "sweet" and "sour" portions). Bids must be made in dollars and cents without use of any punctuation except a decimal point to separate dollars and cents (example: 10.01). Bids below 00.01 or containing a fraction of a cent (example: 10.015) will not be accepted. There are two ways to submit your entry:
1) Online: Visit www.soursweetgone.com during the Promotion Period, click on the “Sour Sweet Gone Auction” and do the following: a) view the current week’s Weekly Prize; b) if you choose to enter the Sweepstakes for the current Weekly Entry Period, enter your code number (obtained from a specially marked package indicated above or the www.soursweetgone.com website) in the space indicated; and c) complete and submit the Official Entry Form including your bid on the current week’s Weekly Prize; OR
2) Text Messaging: During the Promotion Period, text message your code number (obtained from a specially marked package indicated above or the www.soursweetgone.com website) to SPBIDS using a wireless device capable of 2 way text messaging (you must provide your own device). Upon Sponsor’s receipt and verification of submitted code number, you will be sent a text message describing the current week’s Weekly Prize. If you choose to enter the Sweepstakes for the current Weekly Entry Period, reply back, as directed, with your bid on the applicable prize to SPBIDS. Upon completion, you will be sent a text message confirming receipt of your bid. You may opt-out of receiving text messages at any time by following the instructions in the text messages sent to you. Important Notice for Text Messaging Entry Method: Your wireless service provider may charge you for each text message you send and receive in connection with this Sweepstakes. Standard text messaging fees apply. Please consult your wireless service provider regarding their pricing plans. You must be a wireless service subscriber with text messaging service, using a participating service provider in order to enter via this method. Not all wireless service providers carry the necessary service or equipment to participate. Check your wireless device capabilities for specific text messaging instructions.
A code number may only be used once to enter. Bids for any Weekly Entry Period must be received by the deadline specified below for such Weekly Entry Period to be eligible. All entries become the property of Sponsor and will not be acknowledged. Limit 1 entry per person per day, regardless of the method of entry used. Each person who enters must use a separate e-mail address or wireless phone number. Multiple people may not enter from the same wireless phone number or e-mail address. Additional entries in violation of these Official Rules will be void. The use of automated devices (or any other devices intended to automate any aspect of participation) to enter is prohibited. If Sponsor, in its sole discretion, determines that an entrant has used an automated or similar device to enter, all entries from that entrant will be void. In the event of a dispute as to the identity of an online entrant, the entrant will be deemed to be the person named on the applicable online entry form (regardless of whether that is the name of the authorized account holder of the email address from which said online entry form was submitted), provided such individual is eligible according to these rules. In the event of a dispute as to the identity of a text messaging entrant, the entrant will be deemed to be the authorized account holder of the wireless account at issue, provided such individual is eligible according to these rules.
Released Parties are not responsible for: lost, incomplete, invalid, unintelligible, inaccurate, undeliverable, late, damaged, or misdirected code requests, bids, entries, emails or text messages, all of which will be disqualified; failures or malfunctions of phones (including wireless phones/handsets or other wireless devices), phone lines or telephone systems or other communications malfunctions; cellular equipment towers, telephone systems or wireless services; interrupted or unavailable network, server or other connections; miscommunications, failed computer hardware or software or other technical failures; garbled, lost, misrouted or scrambled transmissions; any error, omission, interruption, defect or delay in any transmission or communication; traffic congestion on the internet or for any technical problem, including but not limited to any injury or damage to entrant’s or any other person’s computer or wireless phone/handset or other device related to or resulting from participation in the Sweepstakes; printing, typographical, printing or other errors appearing within these Official Rules or in any Sweepstakes-related advertisements or other materials; other errors or problems of any kind whether mechanical, human, technical, electronic, cellular telephone or wireless device related or otherwise; or errors which may occur in connection with the administration of the Sweepstakes, including, without limitation, the processing of code requests, bids, entries or text messages.
Personal Information: Entrants’ (and, if minors, their parents’ or legal guardians’) personally identifiable information will only be used to enter entrants in the Sweepstakes and for the announcement and notification of potential winners, and otherwise as necessary in connection with the administration of the Sweepstakes, in accordance with the Cadbury Adams USA LLC Privacy Policy, as posted on www.soursweetgone.com. Sponsor will not sell or distribute entrants’ or their parents’ or legal guardians’ personally identifiable information and shall delete all such information upon the full conclusion of the Sweepstakes (except as otherwise outlined in these Official Rules).
Winner Selection/Prizes: The entrant who submits the lowest UNIQUE bid during a Weekly Entry Period, as determined by Sponsor in its sole discretion, will be determined that applicable week’s potential Weekly Prize winner (subject to verification of eligibility, code number and compliance with the terms of these rules), for a total of twenty-eight (28) Weekly Prize winners. (By way of example only, the following is an example of how a “lowest UNIQUE bid” could be established: if the lowest bid is 18.00, but more than one entrant enters a bid of 18.00, then that is not the lowest UNIQUE bid. If the next lowest bid is 19.00, and only one entrant enters a bid of 19.00, then the entrant who entered 19.00 will (subject to the terms hereof) be considered to have submitted the lowest UNIQUE bid and will be determined the potential winner for that applicable Weekly Entry Period.) Potential winners will generally be determined approximately two days after the end of each Weekly Entry Period. The first potential winner will be selected on or about 5/27/08 and the last potential winner will be selected on or about 12/2/08. Each Weekly Entry Period begins at 12:00:00 am ET and ends at 11:59:59 pm ET with the following exceptions: on 5/19/08 the Weekly Entry Period starts at 12:00:00 pm (noon) ET and on 11/30/08 the Weekly Entry Period ends at 11:59:59 am ET. In event that there are no lowest UNIQUE bids for any Weekly Entry Period, the prize will be awarded at random from among all eligible entries received for such Weekly Entry Period. Entries for one Weekly Entry Period will not carry forward to subsequent Weekly Entry Periods. All drawings and winner selection will be conducted by Project Support Team, Inc., an independent judging organization. By participating, entrants (and, if minors, their parents/legal guardians) agree to these Official Rules and to the decisions of the Sponsor and judges, which will be final and binding in all matters relating to this Sweepstakes. If any winner is an eligible minor, prize may, at Sponsor’s discretion, be awarded to the parent or legal guardian who will be responsible for fulfilling all requirements imposed on winners set forth herein. Potential winners (and, if minors, their parents/legal guardians) who entered online will be notified by telephone and/or email and/or overnight or regular mail and provided prize claim information and deadline. Potential winners who entered via text will be notified by text message or phone via the wireless phone number from which the text entry was sent. If potential winner is called and does not answer the phone (or is otherwise unavailable during initial contact attempt) or if potential winner is notified via text, a voice (or text) message will be left including a phone number which potential winner must call to claim his/her prize within 48 hours of the message being recorded (or sent). Other than the one (1) message (voice or text), no further attempt to contact such individual will be made. If a potential winner fails to claim his/her prize in the allotted time, such individual may be disqualified and, at Sponsor’s discretion, the entrant who submitted the next lowest UNIQUE bid for the Weekly Entry Period at issue may be deemed the winner, or if there is no next lowest UNIQUE bid for that Weekly Entry Period, the prize will be awarded at random from among all eligible entries received for such Weekly Entry Period. Odds of winning will depend on the total number of eligible entries received for any Weekly Entry Period. Each entry, whether submitted via online or text, will have an equal chance of winning. You are not a winner until your submissions are validated and you are declared by Sponsor to be an official winner.
All prizes are being awarded “as is” without any warranty or guarantee, either express or implied, by Sponsor. Terms and conditions on gift cards may apply. All prize details (including, but not limited to, exact games, titles, descriptions, sizes, models and brands) are at Sponsor’s sole discretion. Federal, state and local taxes, if any, and any other costs or expenses associated with acceptance and use of prize not specifically stated herein as being awarded are the sole responsibility of the individual winners. Total ARV of all prizes: $17,906.
Miscellaneous: No transfer, assignment, cash redemption or substitution of a prize (or portion thereof) except by Sponsor who may substitute a prize (or portion thereof) with one of comparable or greater value, at its sole discretion.
Potential winners (and, if minors, their parent or legal guardian) may be required to execute and return an Affidavit of Eligibility, Liability and Publicity Release (where legal) within 10 days of date of issuance of notification. Noncompliance with this requirement, or with any other aspect of these Official Rules, or a prize notification being returned as non-deliverable, may result in disqualification and, at Sponsor’s discretion, the entrant who submitted the next lowest UNIQUE bid for the Weekly Entry Period at issue may be deemed the winner, or if there is no next lowest UNIQUE bid for the Weekly Entry Period at issue, the prize will be awarded at random from among all eligible entries received for such Weekly Entry Period.
Sweepstakes materials (including codes) are null and void and will be rejected if not obtained through authorized, legitimate channels or if any part is counterfeited, manipulated, or otherwise tampered with in any way. Entrant (and, if a minor, his/her parent or legal guardian) assumes all risk of loss or damage to, or destruction of, code numbers. Liability for code numbers containing printing, typographical or other errors or for code numbers that are incomplete or rendered inoperable due to any type of malfunction or other error is limited to replacement with one (1) code number, time permitting, for the applicable Weekly Entry Period.
No more than the stated number of prizes will be awarded. Sponsor reserves the right, in its sole discretion, to void any entries/bids of entrants whom Sponsor believes has attempted to tamper with or impair the administration, security, fairness or proper play of this Sweepstakes. CAUTION: Any attempt to deliberately damage any web site or undermine the legitimate operation of this Sweepstakes is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek damages and/or other remedies from any such person(s) responsible for the attempt to the fullest extent permitted by law.
Sponsor reserves the right, in its sole discretion, to modify, suspend, and/or terminate this Sweepstakes or a particular Weekly Entry Period should non-authorized human intervention or other causes, including but not limited to war, strikes, and/or acts of God, corrupt or impair the administration, security, fairness or proper play of the Sweepstakes and, in the case of suspension or termination, at its discretion, select the winner for the Weekly Entry Period at issue from eligible non-suspect online and text entries received for that Weekly Entry Period prior to the event requiring such termination or suspension, and select the winners for all subsequent Weekly Entry Periods for the duration of the Promotion Period from all eligible non-suspect online and text non-winning entries received prior to the suspension or termination.
All entrants and, if minors, their parents or legal guardians agree that New York law shall apply exclusively to the Sweepstakes, without regard to conflicts of law principles, that any dispute with respect to the Sweepstakes shall be resolved in either the federal or state courts located in the State of New York, and in the courts of appellate jurisdiction therefrom, and that they shall waive any defense based on venue or forum non conveniens.
By participating, entrants (and, if minors, their parents/legal guardians) agree: 1) that Sponsor and its designees may use winner’s (and, if a minor, the minor and his/her parent or legal guardian’s) name, submitted bid, city and state of residence, photograph and/or likeness for advertising, trade and/or any other purposes, in any manner, together with any other material, in any and all media now or hereafter known throughout the world in perpetuity, without further compensation, permission or notification (unless prohibited by law); 2) to release and forever discharge the Released Parties from and against any claim, action, liability, loss, injury or damage (including, without limitation, economic injury, personal injury, property damage, loss or any other harm) in any way arising from this Sweepstakes, the acceptance, possession, use or misuse of a prize won or participation in this Sweepstakes, any travel or travel-related activity associated herewith or any other element of this Sweepstakes; and 3) to defend, indemnify and hold harmless the Released Parties from and against any claim, action, liability, loss, injury or damage to entrant or any other person or entity, including, without limitation, economic injury, personal injury or death to entrant or any other person or damage to personal or real property or any other harm, due in whole or in part, directly or indirectly, by reason of the acceptance, possession, use or misuse of a prize won or participation in this Sweepstakes, any travel or travel-related activity associated herewith or any other element of this Sweepstakes. Sponsor is not responsible for any inability of the potential winners to accept a prize, and reserves the right, at its sole discretion, to disqualify or eliminate potential winners and, at Sponsor’s sole discretion, award prizes to alternate potential winners.
